Preamble
These Terms of Use ("ToU") govern access to and use of the website https://www.web-agency.app (the "Site"), published by Axel REGNOULT, sole trader operating under the trade name Axelo (SIRET 895 214 989 00017 — APE code 6201Z — registered address 128 rue de la Boétie, 75008 Paris, France).
These ToU must be read together with the Legal Notice, the Terms and Conditions of Sale, the Hosting Terms, the Privacy Policy, and the Cookie Policy.
Article 1 — Scope and acceptance
These ToU govern the conditions of access and use of the Site by any User, whether acting as a professional (B2B) or as a consumer (B2C).
Access to and use of the Site constitute full and unreserved acceptance of these ToU. A User who does not accept all or part of the ToU must refrain from using the Site. The applicable ToU are those in force on the day of access to the Site.
Article 2 — Definitions
For the purposes of these ToU:
- Publisher / Provider: Axel REGNOULT, operating under the trade name Axelo, sole trader (SIRET 895 214 989 00017).
- Site: the website accessible at https://www.web-agency.app, including its subdomains and associated applications.
- User: unknown person accessing the Site, whether a consumer (B2C) or a professional (B2B).
- Consumer (B2C): unknown natural person acting for purposes which do not fall within their commercial, industrial, craft, professional or agricultural activity (introductory article of the French Consumer Code).
- Professional (B2B): unknown natural or legal person acting for purposes within their commercial, industrial, craft, professional or agricultural activity.
- Services: all features, content and services offered by the Site.
Article 3 — Site access and technical conditions
The Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure, maintenance interruption or technical failure. The Publisher cannot be held liable for any unavailability, slowdown or interruption of the Site, subject to the provisions of Article 9.
The User is solely responsible for the hardware, software and Internet connection required to access the Site, as well as for the associated costs.
Article 4 — Cookie policy
The Site may deposit cookies and similar trackers on the User's terminal. No non-essential cookie is deposited without the User's prior consent, in accordance with CNIL deliberation no. 2020-091.

Article 5 — Personal data (GDPR)
In accordance with Regulation (EU) 2016/679 of 27 April 2016 ("GDPR") and French Act 78-17 of 6 January 1978 as amended by Act 2018-493 of 20 June 2018, the User has the following rights over their personal data: access, rectification, erasure, restriction of processing, portability, objection, and the right to define the fate of data after death.

The User also has the right to lodge a complaint with the French Data Protection Authority (CNIL — complaint form).
Article 6 — Intellectual property and infringement
Axel REGNOULT holds the intellectual property rights in all elements accessible on the Site, including text, images, graphics, logos, videos, architecture, icons, sounds and source code. Any databases on the Site are protected by the provisions of the French Intellectual Property Code (CPI) implementing EU Directive 96/9/EC of 11 March 1996.
Any representation, reproduction, modification, publication, adaptation, or exploitation of all or part of the elements of the Site, by any means whatsoever, without prior written authorisation from Axel REGNOULT, is prohibited and constitutes infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.
Conditions for transfer and use of deliverables developed by Axelo for its clients are defined in Article 4 of the Terms and Conditions of Sale.
Article 7 — Trademarks and logos
The trademarks, names and logos of the Publisher, as well as those of its partners appearing on the Site, are protected under trademark law and copyright. Any reproduction or representation, in whole or in part, without the prior written consent of their holder, is prohibited and constitutes infringement.
Article 8 — Interactive spaces and user content
The Site may offer interactive spaces (contact form, comments, file upload). The User undertakes not to deposit any content:
- contrary to applicable laws and regulations;
- of a defamatory, insulting, racist, pornographic nature, or contrary to public order and morality;
- violating the intellectual property rights or personality rights of third parties;
- containing viruses, malware or any malicious code.
Axel REGNOULT reserves the right to remove, without prior notice, any manifestly unlawful content reported in accordance with Article 6.I.5 of French Act LCEN no. 2004-575 of 21 June 2004. Reports may be sent to legal@web-agency.app with the subject "Unlawful content report".
Where applicable, the User's civil and/or criminal liability may be engaged in case of breach of these obligations.
Article 9 — Limitations of liability
9.1 — For professional users (B2B). Axel REGNOULT shall not be liable for any direct or indirect damages (material and/or financial damage, loss of data, loss of programs, loss of profit) resulting from access to or use of the Site, except in case of gross negligence, fraud or bodily harm.
9.2 — For consumer users (B2C). These limitations do not apply to consumer clients within the limits of the mandatory legal warranties (notably legal warranty of conformity — Articles L.224-25-12 to L.224-25-26 and L.217-3 et seq. of the French Consumer Code — and warranty against hidden defects — Articles 1641 to 1649 of the French Civil Code) and the provisions of Article R.212-1 of the French Consumer Code. Details of applicable legal warranties appear in Article 24 of the Terms and Conditions of Sale.
9.3 — General cases. Axel REGNOULT notably declines all responsibility for damage resulting from:
- interruption of the Site for maintenance or force majeure (art. 1218 of the French Civil Code);
- bugs or viruses not originating from the Site;
- fraudulent intrusion by a third party resulting in modification of information presented on the Site;
- the User's download of elements of the Site onto a terminal with security flaws.
Article 10 — Modification of the Terms of Use
Axel REGNOULT reserves the right to modify these ToU at any time to take account of legislative, regulatory or technical changes. The applicable ToU are those in force on the day of access to the Site. The date of the last update appears at the bottom of this page.
The User is invited to regularly consult these ToU.
Article 11 — Governing law and jurisdiction
11.1 These ToU are governed by French law.
11.2 — Consumer users (B2C). In accordance with Article R.631-3 of the French Consumer Code, the consumer may bring the matter, at their choice, before one of the territorially competent courts under the Code of Civil Procedure, or the court of the place where they resided at the time of conclusion of the contract or the occurrence of the harmful event. Prior recourse to the consumer mediator is encouraged.
11.3 — PROFESSIONAL USERS (B2B) — JURISDICTION CLAUSE.
IN CASE OF DISPUTE BETWEEN PROFESSIONALS, AND FAILING AN AMICABLE SOLUTION, ANY DISPUTE RELATING TO THE INTERPRETATION OR PERFORMANCE OF THESE ToU SHALL FALL UNDER THE EXCLUSIVE JURISDICTION OF THE COMMERCIAL COURT OF PARIS, NOTWITHSTANDING MULTIPLE DEFENDANTS OR WARRANTY CLAIMS.
